The View co-host Sunny Hostin is stepping into the courtroom to defend her son, Gabriel Hostin, after the 24 year old received a trespassing citation in New York last month.
According to documents obtained by TMZ and USA Today, Hostin, who is also a lawyer and former federal prosecutor, submitted a letter to an assistant district attorney in New Rochelle City Court asking that the case be dismissed.
Sunny Hostin says son had “no intent to trespass”
In the letter, Hostin argued that Gabriel, a 2025 Harvard University graduate with no prior criminal record, mistakenly entered the area while exercising.
She explained that her son was out jogging when he noticed what appeared to be a gravel hill suitable for training.
According to Hostin, the entrance gate was open, and the “No Trespassing” sign was not visible from where Gabriel entered the property.
“He reasonably believed the area was accessible and had no intention of entering private property unlawfully,” she wrote.
Court records cited by TMZ and USA Today state that Gabriel received a citation from the Metropolitan Transportation Authority on June 16. He was not arrested in connection with the incident.
Officer reportedly acknowledged gate should have been closed
Hostin said a police officer approached Gabriel after he entered the property. She later arrived at the scene herself.
According to her letter, the responding officer acknowledged that the gate should have been closed, which she argued reinforced Gabriel’s belief that the area was open to the public.

Hostin emphasized that her son “had no intent to trespass,” noting that he was not arrested, fingerprinted or charged with any criminal offense.
“My client has worked diligently to build an exemplary academic and personal record,” she wrote.
She described the incident as “an honest mistake” and argued that continuing the case would not serve the interests of justice.
“The continued prosecution of this violation… serves neither the interests of justice nor the public interest,” Hostin wrote. “Dismissal would avoid imposing unnecessary consequences on a young man who has demonstrated exceptional character and achievement and who poses no risk to the community.”
Court appearance scheduled later this month
Gabriel Hostin is scheduled to appear in New Rochelle City Court on July 31, with Sunny Hostin officially representing him as his attorney.
Sunny shares Gabriel and 20 year old daughter Paloma with her husband, orthopedic surgeon Emmanuel Hostin.
As of now, court officials have not publicly commented on whether prosecutors intend to dismiss the citation.
